1. Introduction

Welcome to GameFest Live. These Terms of Service ("Terms") govern your access to and use of our website, services, and events. By accessing or using GameFest Live services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

GameFest Live reserves the right to modify these Terms at any time. We will notify users of any material changes via email or through prominent notices on our website. Your continued use of our services after such modifications constitutes acceptance of the updated Terms.

2. Acceptance of Terms

By creating an account, purchasing tickets, or attending GameFest Live events, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. You represent that you are at least 18 years of age, or if you are under 18, you have obtained parental or guardian consent to use our services.

These Terms constitute a legally binding agreement between you and GameFest Live Pty Ltd, a company registered in Australia. Your use of our services is also subject to applicable local, state, national, and international laws and regulations.

3. User Accounts

To access certain features of GameFest Live, you may be required to create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify GameFest Live of any unauthorized use of your account or any other breach of security.

GameFest Live reserves the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or pose a security risk to our platform or other users.

4. Ticket Purchase and Event Access

All ticket purchases are subject to availability and acceptance by GameFest Live. We reserve the right to refuse service, cancel orders, or deny event access to anyone for any reason at any time. Ticket prices are subject to change without notice until purchase is completed.

Tickets are non-transferable and non-refundable except as required by law or in cases of event cancellation by GameFest Live. Valid identification matching the name on the ticket may be required for entry. Resale of tickets at prices exceeding face value is strictly prohibited.

By purchasing a ticket, you agree to comply with all event rules and regulations, including security screening, prohibited items policies, and codes of conduct. GameFest Live reserves the right to remove any attendee who violates these rules without refund.

5. Intellectual Property Rights

All content on the GameFest Live website and at our events, including but not limited to text, graphics, logos, images, video, audio, and software, is the property of GameFest Live or its content suppliers and is protected by international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of our content without prior written consent from GameFest Live, except for personal, non-commercial use.

The GameFest Live name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of GameFest Live or its affiliates. You may not use such marks without our prior written permission.

6. User Conduct and Prohibited Activities

You agree not to engage in any of the following prohibited activities: (a) copying, distributing, or disclosing any part of the service in any medium; (b) using any automated system to access the service; (c) transmitting spam, chain letters, or other unsolicited email; (d) attempting to interfere with or compromise system integrity or security; (e) collecting or harvesting any personally identifiable information from the service; (f) impersonating another person or misrepresenting your affiliation with a person or entity; (g) uploading or transmitting viruses or malicious code; or (h) engaging in any other conduct that restricts or inhibits anyone's use or enjoyment of the service.

At GameFest Live events, you agree to conduct yourself in a respectful manner toward all attendees, staff, exhibitors, and performers. Harassment, discrimination, violence, or threatening behavior of any kind will not be tolerated and may result in immediate removal and potential legal action.

7. User-Generated Content

GameFest Live may allow users to submit, upload, or post content such as comments, reviews, photos, or videos. By submitting content, you grant GameFest Live a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in any media.

You represent and warrant that you own or have the necessary rights to submit the content and that the content does not violate any third-party rights or applicable laws. GameFest Live reserves the right to remove any content that violates these Terms or is otherwise objectionable.

GameFest Live does not endorse any user-generated content and is not responsible for the accuracy, completeness, or usefulness of such content. Users interact with user-generated content at their own risk.

8. Photography, Video, and Media Rights

By attending GameFest Live events, you acknowledge and agree that you may be photographed, filmed, or recorded, and you grant GameFest Live the unrestricted right to use your name, image, likeness, and voice in any media for promotional, marketing, or commercial purposes without compensation.

Personal photography and video recording for non-commercial purposes is generally permitted at events unless otherwise stated. However, professional equipment may be restricted, and recording of certain presentations or areas may be prohibited. Always respect the rights and privacy of other attendees when taking photos or videos.

9. Disclaimer of Warranties

GameFest Live services and events are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

GameFest Live does not warrant that our services will be uninterrupted, timely, secure, or error-free, that defects will be corrected, or that our servers are free of viruses or other harmful components. We make no warranties about the accuracy, reliability, completeness, or timeliness of content or services.

Event schedules, featured games, and guest appearances are subject to change without notice. GameFest Live is not responsible for any changes, cancellations, or substitutions that may occur.

10. Limitation of Liability

To the fullest extent permitted by applicable law, GameFest Live shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from: (a) your access to or use of or inability to access or use our services; (b) any conduct or content of any third party on the services; (c) any content obtained from the services; or (d) unauthorized access, use, or alteration of your transmissions or content.

In no event shall GameFest Live's total liability to you for all claims exceed the amount you paid to GameFest Live in the twelve months prior to the action giving rise to liability, or one hundred Australian dollars (AUD $100), whichever is greater.

11. Indemnification

You agree to defend, indemnify, and hold harmless GameFest Live, its officers, directors, employees, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of our services.

This indemnification obligation will survive the termination of these Terms and your use of our services.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Western Australia, Australia, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or our services shall be resolved exclusively in the courts of Western Australia.

Before filing any formal legal action, you agree to first contact GameFest Live to attempt to resolve any disputes informally. We will make reasonable efforts to resolve disputes through good faith negotiation.

13. Termination

GameFest Live may terminate or suspend your account and access to our services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use our services will immediately cease.

All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

14. Severability and Waiver

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

GameFest Live's failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of GameFest Live.

15. Changes to Terms of Service

We reserve the right to modify or replace these Terms at our sole discretion at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our services after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use our services.
